$6.27 Million Lawsuit After Plaintiff Dies Three Years After Collision

Multiple parties will pay $6.27 million to the heirs of a woman who died three years after a car collision.

The decedent, Kimberly Day, survived the collision and subsequent treatment but died three years later. The incident hastened Day’s death, according to Todd Muchnick.

“It was an unfortunate case that left a woman bedridden for the rest of her life,” Muchnick said.

Beverly Brammer was driving a Jeep Patriot with Kimberly Day as a passenger. According to the lawsuit, an ASM Enterprises commercial vehicle driver waved another driver, Blake Ollar, out of a private driveway and into the path of Brammer. The woman, who was in her 60s, suffered broken hip and spinal bones as well as brain damage as a result of her stay on a respirator following the T-bone collision.

“She had pretty catastrophic injuries,” Muchnick said. “She was on life support at Missouri University Hospital for probably 60 days or more.”

Ollar’s employer’s insurance, Lanier Exteriors, contributed $5.9 million to the settlement. Muchnick stated that ASM paid $20,000 even though the company disputed that their driver waived out Ollar. There was some debate about whether the company could be held liable.

“Typically, the one who waves out the car is not identified,” he said. “Usually, it becomes an uninsured motorist claim.”

Muchnick stated that a multimillion-dollar life care plan existed, but it was null and void when Day died.

Lanier’s attorney, David Ahlheim, declined to comment. Kaci Peterson, who represented ASM, did not return a phone call.
